Terms of Service

These Terms of Service ("Terms") govern your use of serversculpt.com and the services provided by serversculpt ("we", "our", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

serversculpt provides a managed platform for launching and operating self-hosted applications (such as WordPress) on isolated cloud infrastructure. We provide the control plane, container orchestration, and supporting services; you control the content and configuration of your instances.

2. Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the service.
You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
You must provide accurate and current contact and billing information.

3. Acceptable use

You agree not to use the service to:

Host or distribute illegal content, malware, or material that infringes the rights of others.
Engage in spamming, phishing, or other deceptive practices.
Attempt to disrupt, reverse-engineer, or gain unauthorized access to our systems or other customers' instances.
Violate any applicable law or regulation.

We may suspend or terminate accounts that violate these rules.

4. Fees and billing

Service plans and pricing are described on our website at the time of purchase.
Payments are processed by Paystack and other licensed payment partners. By providing payment information, you authorize us to charge the applicable fees on a recurring basis.
Fees are non-refundable except where required by law or expressly stated in our refund policy.
We may change pricing with at least 30 days' notice; changes take effect at your next renewal cycle.

5. Your content

You retain ownership of all content you upload to or run on your instances. You grant us a limited license to host, process, and back up that content solely to provide the service. We do not access or use your content for any other purpose.

6. Service availability

We aim for high availability but the service is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free. Scheduled maintenance will be announced in advance where reasonably possible.

7. Termination

You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or for legal or security reasons. On termination, your instances and associated data may be permanently deleted after a reasonable grace period.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Governing law

These Terms are governed by the laws of Kenya, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Nairobi for any dispute arising from these Terms or the service.

10. Changes

We may update these Terms from time to time. Material changes will be communicated by email or via a notice on this page. Continued use of the service after changes take effect constitutes acceptance.
